Acceptable Use Policy
This Acceptable Use Policy (the “AUP”) sets out what you may and may not do when using Persevo. It applies to every customer, every account, and every end-shopper interaction that runs through the Service. The AUP is incorporated into the Terms of Service.
1. Purpose
Persevo is commerce infrastructure. We facilitate payments, host sensitive shopper data and process orders for businesses across Europe. To keep the platform safe, lawful and reliable for everyone, we draw clear lines around the goods sold through it and the activities conducted with it.
2. Prohibited goods, services and content
You may not use the Service to sell, promote, distribute, or facilitate any of the following:
- Goods or services that are illegal where the seller or the buyer is located.
- Weapons, firearms and ammunition, and parts, accessories or conversion components for them, regardless of local licensing.
- Explosives, fireworks and other regulated pyrotechnics outside of the limited cases permitted by law and our payments partner.
- Controlled substances, narcotics, illegal drugs, drug paraphernalia, new psychoactive substances, and unregistered or unapproved pharmaceuticals.
- Tobacco, electronic nicotine-delivery systems and refills sold to jurisdictions or buyers where this is prohibited.
- Goods or services that infringe third-party intellectual property, including counterfeit goods, replica designer items, and pirated digital content.
- Sexual content involving minors of any kind. Reports of such content will be referred to law-enforcement authorities without notice.
- Adult content, sexually explicit goods or services, escort or companionship services in jurisdictions where any of these are unlawful or where our payments partner prohibits them.
- Pyramid, multi-level marketing and other schemes whose income depends primarily on recruitment, and “get rich quick” offers.
- Gambling, betting, lotteries, sweepstakes and skill-game services that lack the required licensing in the markets served.
- Unregulated financial products and services, virtual-currency exchanges and money-transmission services that lack the required licensing.
- Stolen goods, including digital goods, accounts and credentials.
- Goods or services that promote, glorify or incite hatred, violence or terrorism against people based on protected characteristics.
- Personal data sold as a primary product, mailing lists obtained without lawful basis, and credentials.
- Hazardous materials and substances whose distribution is restricted (for example, by REACH or analogous regulation) outside the permitted channels.
- Live animals, endangered-species products (CITES) and products derived from them.
- Any other category that our payments partner, card networks or competent authorities classify as prohibited or restricted.
Some of the above categories may be permitted on a case-by-case basis where the Customer holds the necessary licences and our payments partner has approved the merchant category. Contact legal@persevo.app before going live with anything that may fall close to a restricted category.
3. Prohibited activities
You agree not to do, attempt to do, or knowingly permit anyone to do any of the following with the Service:
- Use the Service to commit, attempt or facilitate fraud, money laundering, terrorist financing, tax evasion or sanctions evasion.
- Misrepresent the nature of your business, products, prices, shipping terms or refund policy to your end-shoppers.
- Process transactions that do not originate from a genuine sale to the cardholder, including self-payments, balance transfers, synthetic identities or tester transactions outside the sandbox.
- Stuff baskets, fabricate orders, or otherwise inflate volume metrics.
- Use the API or dashboard to access, attempt to access, or interfere with data, accounts, networks or systems that do not belong to you.
- Evade or attempt to evade rate limits, throttling, security controls, IP-allowlisting, MFA, or authentication mechanisms.
- Probe, scan or test the vulnerability of the Service or our infrastructure other than under our coordinated responsible-disclosure process at security@persevo.app.
- Reverse-engineer, decompile or otherwise attempt to derive source code from the Service, except to the extent permitted by mandatory law.
- Use the transactional-email channel to send marketing messages, bulk newsletters or any communication that is not a direct consequence of a shopper transaction.
- Send unsolicited commercial communications (spam) to end-shoppers or to anyone else through the Service.
- Upload, transmit or store malware, viruses, worms, exploit payloads, or any code intended to disrupt or compromise systems.
- Use the Service to scrape, harvest or build databases of personal data without a lawful basis.
- Resell or sublicense the Service without our written agreement.
- Use the Service to make automated decisions that have legal or similarly significant effects on individuals without complying with the safeguards required by data protection law.
4. Security and platform integrity
Customers are co-responsible for the security posture of their accounts. You agree to:
- Enable multi-factor authentication for administrator accounts and for any account that can configure payments, refunds or webhooks.
- Keep API keys and webhook signing secrets confidential and rotate them when staff with access leave or change roles.
- Validate webhook signatures and treat webhook payloads as untrusted until verified.
- Report suspected security issues responsibly to security@persevo.app and refrain from public disclosure until we have had a reasonable opportunity to investigate and remediate.
5. Restricted jurisdictions and sanctions
You may not use the Service in or from any jurisdiction targeted by comprehensive EU, UN, UK or US sanctions, nor may you use it to deal with persons or entities subject to relevant sanctions or asset freezes. We may screen against applicable lists and block transactions or accounts where we reasonably believe doing so is required to comply with sanctions law.
6. Enforcement
We monitor the Service for abuse and respond to credible reports of violations. Where we identify a potential breach of this AUP, we may, depending on severity:
- contact the Customer to understand the activity;
- ask the Customer to remedy the issue within a defined period;
- restrict or suspend access to specific features (for example, new transactions);
- suspend or terminate the account in line with the Terms of Service;
- refuse to release funds where we are required by law, by the card networks or by our payments partner to hold them;
- notify and cooperate with law-enforcement or supervisory authorities where required.
Where the violation poses an immediate risk to security, to the platform, to other customers or to end-shoppers, we may act without prior notice and provide an explanation afterwards.
7. Reporting violations
If you believe a Persevo customer or end-shopper is violating this AUP, please email abuse@persevo.app with as much detail as possible (URLs, order references, screenshots). We treat such reports as confidential to the extent permitted by law.
8. Changes
We may update this AUP from time to time. Material changes will be notified to customers by email or in-product notice with at least 30 days’ notice, unless the change is required to address a legal or security risk that demands immediate action.
